GoHub Optical Wizard – Terms of Use & Privacy Notice

1. You are now using the GoHub Optical Wizard
By clicking "add lens", you have opened the GoHub Optical Wizard (the "Wizard"), a lens selection service provided by Global Optic Hub LLC, 30 n Gould st Ste R sheridan wy 82801, operating as "GoHub" ("we", "us"). The Wizard lets you configure prescription and non-prescription lenses for frames sold in the online store you are visiting, which is operated by an independent retailer (the "Retailer"). These combined Terms of Use and Privacy Notice ("Terms") are an agreement between you and GoHub and govern your use of the Wizard; your purchase itself is a contract with the Retailer under the Retailer's terms of sale and return policy. By using the Wizard you accept these Terms.
2. Eligibility and your prescription
You must be at least 18 years old (or the age of majority where you live) to order. If you order for a minor, you confirm you are the parent or legal guardian and are responsible for entering the prescription accurately. Prescription lenses are custom-made to the values you provide. You represent and warrant to GoHub and the Retailer that:
- Your prescription was issued to the intended wearer by a licensed eye care professional, is valid on the order date and, if it has no expiry date, was issued within the last 24 months;
- All values you enter (sphere, cylinder, axis, addition, prism, pupillary distance) are correct, complete and match your written prescription; and
- The intended wearer is not registered blind or partially sighted.
Neither GoHub nor the Retailer is responsible for lenses made to values you entered incorrectly or to an expired or unsuitable prescription. Your statutory return and warranty rights against the Retailer remain unaffected. GoHub and/or the Retailer may ask for a copy of your prescription, contact your eye care professional to verify it (you consent to such contact), or reject an order with incomplete, infeasible or invalid values, with any payment refunded by the Retailer.
3. Pupillary distance (PD)
Your PD should be measured by your eye care professional. Any measurement tool offered in the Wizard provides an estimate only. If you do not provide a PD, a standard average value may be used; lenses based on an average or self-measured PD may not perform as well, and such orders are placed at your own choice. Your return rights under the Retailer's policy and statutory law remain unaffected.
4. Not medical advice
THE WIZARD IS A PRODUCT CONFIGURATION TOOL. IT DOES NOT PROVIDE MEDICAL ADVICE, EYE EXAMINATIONS, DIAGNOSES OR TREATMENT, AND NO OPTICIAN-PATIENT OR DOCTOR-PATIENT RELATIONSHIP IS CREATED BY ITS USE. LENS RECOMMENDATIONS, THICKNESS SIMULATIONS AND COATING VISUALIZATIONS ARE GENERAL PRODUCT INFORMATION AND ILLUSTRATIONS ONLY. ALWAYS CONSULT A QUALIFIED EYE CARE PROFESSIONAL FOR EXAMINATIONS, AN UP-TO-DATE PRESCRIPTION AND ANY QUESTION ABOUT YOUR VISION OR EYE HEALTH.
5. Permitted use and intellectual property
We grant you a personal, revocable, non-transferable right to use the Wizard to configure lenses for your own (or your household's) personal purchase. You may not use it for commercial purposes, copy, modify, reverse engineer or scrape it, interfere with its security, submit false or third-party prescription data without authority, or access it by automated means. The Wizard and its software, design and content are owned by GoHub or its licensors; no other rights are granted. We may modify, suspend or discontinue the Wizard at any time; orders already accepted are not affected.
6. Your data and how we use it
The Retailer is the seller and the data controller (or responsible business) for your purchase; GoHub processes the data you enter in the Wizard on the Retailer's behalf under a data processing agreement, and is responsible for the Wizard's operation and security. Through the Wizard we collect: prescription data (SPH, CYL, axis, ADD, prism, PD, or an uploaded prescription), lens configuration data (lens type, material, thickness, coatings, frame), order and contact data (name, email, address, phone; payment is handled by the Retailer's payment provider, not the Wizard) and technical data (device, IP, session interactions). The Wizard uses only strictly necessary cookies, does not track you across other websites and honors opt-out signals such as Global Privacy Control where required.
Your prescription is health data. In the EEA, UK and Switzerland it is special category data under Article 9 GDPR, processed only with your explicit consent given in the Wizard; other data is processed to perform your order, comply with law, and secure the service. In the United States it is consumer health data or sensitive data under laws including the Washington My Health My Data Act and the CCPA/CPRA, collected and shared only with your consent. We use your data solely to configure, price, produce, deliver and support your lens order and to secure the Wizard. We do not sell your data, do not use it for advertising, and do not give it to advertising or analytics companies. You may withdraw your consent at any time; this may mean your order cannot be completed or supported.
Sharing, transfers and retention. Your data is shared only with the Retailer (to complete your purchase and provide customer service; the Retailer's service staff may also view — but not download, store or further share — your prescription data in GoHub's secure dashboard, solely to handle a customer service inquiry you initiate), optical laboratories in the GoHub network (production data only), delivery providers (name and address only) and GoHub's IT providers under data processing agreements, or where required by law. GoHub is established in Israel, which the European Commission recognizes as providing adequate data protection; other transfers are protected by adequacy decisions or Standard Contractual Clauses, with encryption in transit and at rest. Prescription and configuration data is kept 24 months after your order (abandoned sessions are deleted within 30 days), order records as required by tax and commercial law, and security logs up to 12 months; data is then deleted or anonymized.
7. Your privacy rights
Depending on where you live, you may access, correct, delete and receive a copy of your data, restrict or object to processing, withdraw consent, and opt out of sale, targeted advertising and profiling (your health data is not sold or shared in any event). Under the Washington My Health My Data Act you may also confirm whether consumer health data is collected or shared, obtain a list of recipients, withdraw consent and have it deleted. Exercise your rights free of charge via cs@goptichub.com or the Retailer; we respond within the legally required time (one month under GDPR; 45 days under most US state laws, extendable once), verify your identity, and accept requests from authorized agents. You will not be discriminated against for exercising your rights, you may appeal a refusal, and you may complain to your local supervisory authority or state Attorney General. EU representative: GoHub Ltd, Triaditsa District, Sofia 1463, Bulgaria. We do not knowingly collect data directly from children.
8. Liability
EU/EEA and UK consumers: you have statutory conformity rights against the Retailer, and nothing in these Terms excludes rights or liability that cannot be excluded under applicable consumer law (including death or personal injury caused by negligence, fraud, intent or gross negligence). Subject to that, GoHub is liable only for foreseeable damage typical for this type of service caused by breach of a material obligation.
OTHERWISE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: THE WIZARD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED; IN NO EVENT WILL GOHUB, ITS AFFILIATES, OR ITS OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, USE OR DATA, ARISING OUT OF OR RELATING TO THE WIZARD OR THESE TERMS; AND GOHUB'S TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
This section governs the Wizard only; product claims are governed by the Retailer's terms of sale, return policy and warranty, and nothing here limits claims under applicable product liability law. To the extent permitted by law, you will indemnify GoHub and the Retailer against third-party claims arising from your breach of Section 2 or unlawful use of the Wizard (not applicable to consumers where unenforceable).
9. Governing law and disputes
Outside the United States: these Terms and any related dispute are governed by the laws of the State of Israel, with exclusive jurisdiction in the competent courts of Tel-Aviv-Jaffa, Israel. If you are an EU or UK consumer, you keep the protection of the mandatory consumer laws of your country of residence and may bring proceedings there; the EU online dispute resolution platform is at https://ec.europa.eu/consumers/odr.
United States consumers: these Terms are governed by the laws of the State of New York (without depriving you of mandatory protections of your state). Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in English, in your county of residence or remotely; judgment on the award may be entered in any competent court, and either party may instead bring an individual claim in small claims court. YOU AND GOHUB EACH WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT IN ANY CLASS OR REPRESENTATIVE PROCEEDING. You may opt out of arbitration by emailing cs@goptichub.com within 30 days of first using the Wizard. Either party may seek injunctive or equitable relief in any competent court to prevent irreparable harm.
Mass filings. If twenty-five (25) or more similar demands for arbitration are filed against GoHub by the same or coordinated counsel or organizations, the AAA's Mass Arbitration Supplementary Rules and Fee Schedule then in effect shall apply. The parties agree that the demands shall be resolved in staged batches: ten (10) demands per side shall first be selected and arbitrated as bellwether proceedings, the remaining demands shall be held in abeyance (with any applicable statutes of limitation tolled) pending their resolution, and following the bellwether awards the parties shall engage in a mediated global settlement conference before further batches proceed. If any part of this paragraph is found unenforceable, the remaining dispute provisions of Section 9 continue to apply.
10. General, changes and contact
If any provision is invalid, the remainder stays in effect. Failure to enforce is not a waiver. You may not assign these Terms; GoHub may assign them to an affiliate or successor. The Retailer is an intended third-party beneficiary of Sections 2 and 8. We may update these Terms and this privacy notice from time to time; the version in force when you order applies to that order, and material changes affecting your health data will be notified and, where required, re-consented.
