Biometric Data Policy

Several U.S. states have laws regulating certain data under the broad umbrella term of “biometric identifiers” or “biometric information” (“Biometric Data”). This policy describes how we collect, use, and share (collectively “process” or “processing”) Biometric Data and the rights certain consumers (“Consumer”, “Consumers”, "you", or "your") may have.

This Policy applies solely to Consumers in states or jurisdictions with laws pertaining to Biometric Data and that require such policies. To the extent that any personal data may be considered Biometric Data pursuant to these laws, this policy provides our practices regarding the collection, use, disclosure, storage, retention, destruction, and security of that data. We are committed to complying with applicable laws and regulations when processing Biometric Data, including those laws and regulations that may require us to provide notice or obtain consent prior to processing what some laws and regulations may deem Biometric Data. You may withdraw your consent at any time by contacting us as described below.

Definitions

For the purposes of this policy, "Biometric Identifier" means a retina or iris scan, fingerprint, voiceprint, scan of hand or face geometry, or other unique biological patterns or characteristics. Biometric identifiers do not include writing samples, written signatures, human biological samples used for valid scientific testing or screening, demographic data, tattoo descriptions, or physical descriptions such as height, weight, hair color, or eye color.

For the purposes of this policy, "Biometric Information" means the measurement or technological processing of any data, regardless of how it is captured, converted, stored, or shared, based on an individual's biometric identifier that identifies a consumer, whether individually or in combination with other data to identify an individual. Biometric Data does not include data derived from items or procedures excluded under the definition of Biometric Identifier.

Disclosure of Biometric Data

Biometric Data may be securely stored on a server database hosted by one of our third-party service providers, or otherwise made available or disclosed to such service providers, as needed, to operate and maintain the VTO service. Further, we may disclose Biometric Data to retained attorneys and/or consultants as necessary to assist us with compliance, conduct audits and investigations, provide related services, or as otherwise permitted or required by law or legal process. In the event additional parties need access to Biometric Data for technical support, administration, or other lawful purposes, we will only provide such access in accordance with applicable law and other best practices.  

We will not sell, lease, trade, or otherwise profit from your Biometric Data.

Security

Safeguarding Biometric Data is important to us. While no systems, applications or websites are 100% secure, we strive to establish reasonable systems, policies and procedures to protect Biometric Data from loss, destruction, misuse, and unauthorized access, acquisition, disclosure or alteration.

Retention and Destruction

We will retain employee Biometric Data only until, and shall request that our vendors permanently destroy such data when, the first of the following occurs:

      The purpose for collecting or obtaining such Biometric Data has been satisfied,

        or,  within 1 year of the initial collection of the Biometric Data. If Biometric Data is 

        processed by a third-party vendor on our behalf, they are contractually required to 

        destroy the Biometric Data after processing.

Where permitted under applicable law, we will retain Biometric Data if required to do so per a valid warrant or subpoena issued by a court of competent jurisdiction or if necessary for the establishment, exercise or defense of legal claims or whenever courts are acting in their judicial capacity.

What Biometric Data is Collected and Purposes for Collection

We may collect your Biometric Data when you use our virtual try-on (VTO) experience. More specifically, the VTO experience collects facial scan and image data to provide customized information for the user, and improve GopticHub’s eyewear prediction and recommendation models.

The Biometric Data processed through the VTO experience is used solely to:

  • operate and deliver the VTO functionality requested by the user;
  • ensure accurate positioning, alignment, and rendering of eyewear products on the user’s face; and
  • improve the accuracy, performance, and reliability of GoHub’s eyewear prediction and recommendation models in an aggregated and non-identifying manner.

Biometric Data collected through the VTO experience is not used to identify individuals, not used for facial recognition, and not used for identity verification, authentication, or tracking across sessions or services. The processing of Biometric Data occurs only for the duration necessary to provide the VTO experience and for the purposes described above, in accordance with this policy and applicable law.

However, for feature functionality and to improve our services, we do collect a limited set of non-personally identifiable “telemetry data” that we receive from your device’s camera. This telemetry data includes:

        ∙       Confirmation that a person is in the camera's view (to activate the feature).

∙       Your general orientation relative to the camera (e.g., facing forward, to the side).

∙       Estimated skeletal joint positions, used solely for positioning the product.

Why we process your Biometric Data?

We may process your Biometric Data only to the extent necessary to provide the virtual 

try-on (VTO) functionality requested by the user and for no other purpose.

Specifically, we process Biometric Data in order to:

  • enable the real-time virtual try-on experience by accurately positioning and rendering eyewear products on the user’s face.
  • provide size, fit, alignment, and visual representation information related to eyewear products.
  • ensure the technical performance, accuracy, and reliability of the VTO functionality.
  • improve the quality and effectiveness of our eyewear prediction and recommendation capabilities in an aggregated and non-identifying manner.

Use of Artificial Intelligence

We may leverage artificial intelligence (AI) to process your Biometric Data to improve our services and offer enhanced functionalities. This includes, but is not limited to, providing Virtual Try On. You may always opt out of personalization use by email to marketing@goptichub.com
